Terms and conditions of donations of the service kotekmarysi.pl

§1 General provisions

1. These Regulations set out the rules for making monetary donations through the online service available at https://kotekmarysi.pl (hereinafter: „Service”).
2. Donations are made voluntarily by users of the Service (hereinafter: „Donors”) for the purposes described in the Service.
3. The Terms and Conditions are made available free of charge on the Website in a way that allows you to read them before making a donation.

§2 Definitions

For the purposes of these Regulations, the following definitions are adopted:

• Donor - An individual making a voluntary monetary donation through the Service.
• Donation - A voluntary, non-refundable monetary benefit provided by the Donor.
• Payment operator - PayPro S.A., which operates the Przelewy24 service.
• Service - website https://kotekmarysi.pl.

§3 Nature of donations

1. All donations made through the Service are of the following nature voluntary and non-refundable.
2. The making of a donation does not constitute the conclusion of a contract of sale or a contract for the provision of services.
3. By making a donation, the donor confirms that he or she is acting voluntarily and without expectation of reciprocal benefit.

§4. donation process

1. The donation is made through a form available on the Website.
2. In order to make a donation, the Donor provides:
   • name,
   • email address,
   • donation amount,
   • optional comment.
3. Donors can choose whether their data (name, surname, comment) will be publicly visible on the subpage https://kotekmarysi.pl/wesprzyj/.
4. After completing the form, the Donor is redirected to the payment provider's system to complete the transaction.

§5 Payments

1. Payment processing on the Website is provided by the Payment Operator -. Przelewy24 (PayPro S.A.).
2. Available payment methods are presented each time in the system of the Payment Provider.
3. The donation is processed after the payment process is properly completed by the Operator.
4. The service is not responsible for any interruptions or errors in the operation of the payment operator's system.

§6 Publication of Donor Data

1. Donor data in the form of name and commentary may be displayed publicly on the site https://kotekmarysi.pl/wesprzyj/.
2. The donor has the option of hiding his or her data from public access through the appropriate option on the donation form.
3. Donor's e-mail address is not published and is used solely for the purpose of handling the donation.

§7 Personal data

1. The administrator of Donors' personal data is the owner of the Website.
2. Personal data is processed for the purpose of:
   • implementation of donations,
   • payment processing,
   • Ensure transparency of support (when data is published).
3. Personal data are transferred to the Payment Operator only to the extent necessary for payment processing.

§8 Right to withdraw from donation

1. Donations made through the Service are, as a rule, non-refundable.
2. In justified cases, the Donation may be reimbursed at the request of the Donor.
3. The request for return of the Donation should be made electronically by sending a message to the e-mail address indicated on the Service.
4. The application should include at least:
   • Name of the Donor,
   • The email address used in making the donation,
   • donation amount,
   • The date of the donation,
   • rationale for the proposal.
5. The decision on the return of the Donation is made on an individual basis and communicated to the Donor by e-mail.
6. If the request is granted, the donation is returned within 14 days, in the same form of payment in which the donation was made, if technically possible.

§9 Complaints

1. Complaints about payment processing should be reported in the first instance to the payment operator Przelewy24.
2. Complaints about the operation of the Service may be submitted by e-mail to the address indicated on the Service.
3. Complaints are processed within 14 days of receipt.

§10 Final provisions

1. The Regulations are effective as of the date of their publication on the Website.
2. The organizer reserves the right to change the Terms and Conditions, but the changes do not affect donations made before they take effect.
3. In matters not covered by these Regulations, the provisions of Polish law shall apply.
